Biocides – Differentiated enforcement policy NL

Before a biocidal product can be put on the Dutch market officially, it has to be approved by the Board for the Authorisation of Plant Protection Products and Biocides (Ctgb). At this very moment hundreds of biocidal products are on the Dutch market without official authorisation. The formal policy will now be enforced. To allow companies to register non-authorised biocidal products via a short-track, the differentiated enforcement policy was put in place.
 
WG/GA/PUB before 15 June 2010
The first stage of the differentiated enforcement policy NL (i.e. notification) ended 15 September 2009. The marketing of any biocidal product that has been notified via the short track procedure is permitted for the time being.
For each biocidal product notified the draft “legal instruction for use”( (WG/GA) together with an appendix “practical use of biocide” (PUB) have to be submitted to the Ctgb before 15 June 2010 irrespective of the urgency colour code group your product was placed in.

For each biocidal product a dossier needs to be submitted, obeying the time table according to the following colour coding:
- Red category: complete application for authorisation to be submitted by 15 December 2010 at the latest
- Orange category: complete application for authorisation to be submitted by 15 June 2012 at the latest
- Yellow category: complete application for authorisation to be submitted by 15 May 2013 at the latest

Enforcement entails that if no information on use or an incomplete application has been received by the deadlines the biocidal product will be removed from the list of notified products and has to be removed from the market immediately. For these products as well as for the not-notified biocidal products a new application via the normal procedure applies before it can be marketed again.
